1. Agreement to Terms

By engaging our digital billboard advertising services, you agree to be bound by these Terms and Conditions. Fairmount Outdoor Advertising ("we," "us," or "our") provides digital billboard advertising services at Highway 174 & 4th Street, Joshua, Texas.

2. Services Description

We provide digital billboard advertising display services featuring:

• 10'6" × 36' LED digital display
• Located at Highway 174 & 4th Street, Joshua, TX
• Visible to both northbound and southbound traffic
• 24/7 exposure capability
• Reaching approximately 32,500 daily commuters
• Proof-of-play reporting when available

3. Content Guidelines

All advertising content must comply with the following guidelines:

• Must be legal and not promote illegal activities
• Cannot contain obscene, offensive, or inappropriate material
• Must not infringe on third-party intellectual property rights
• Must comply with local, state, and federal advertising regulations
• Cannot contain flashing or strobing elements that may cause driver distraction
• Must be suitable for public display and general audiences

We reserve the right to reject any content that does not meet these guidelines or may be deemed inappropriate for display.

4. Payment Terms

• Payment is due in advance of campaign start date
• Pricing is based on duration, frequency, and scheduling requirements
• Additional fees may apply for rush orders or special scheduling requests
• Refunds are subject to our cancellation policy outlined below
• All prices are subject to applicable taxes

5. Cancellation Policy

Cancellation terms are as follows:

• Cancellations made 7+ days before campaign start: Full refund minus processing fees
• Cancellations made 3-6 days before campaign start: 50% refund
• Cancellations made less than 3 days before campaign start: No refund
• Campaign modifications may incur additional fees

6. Limitation of Liability

Our liability is limited to the amount paid for advertising services. We are not responsible for: technical failures, weather-related visibility issues, power outages, or other circumstances beyond our control. We make no guarantees regarding specific audience reach or advertising effectiveness.

7. Intellectual Property

Clients retain ownership of their advertising content. By submitting content, clients grant us a limited license to display the content for the agreed-upon campaign duration. Clients are responsible for ensuring they have all necessary rights to the content they submit.

8. Technical Specifications

Digital content must meet the following specifications:

• Resolution: 180 × 660 pixels
• File formats: MP4, JPG, PNG
• File size: Maximum 50MB per file
• Duration: Video content maximum 15 seconds
• Content must be provided at least 48 hours before campaign start

9. Force Majeure

We are not liable for delays or failures due to circumstances beyond our control, including but not limited to: natural disasters, power outages, equipment failures, government regulations, or other unforeseeable events.

10. Modifications to Terms

We reserve the right to modify these terms at any time. Changes will be posted on our website and will apply to future contracts. Existing contracts will remain under the terms agreed upon at the time of signing.
